Agreement & Acceptance
By accessing or using Kshetra AI services, you agree to be bound by these terms:
- These terms constitute a legally binding agreement between you and Passionfrut Technologies
- Your use of our services indicates acceptance of all terms, conditions, and policies
- If you disagree with any part of these terms, you must discontinue use immediately
- These terms apply to all users, including visitors, registered users, and premium subscribers
- Additional terms may apply to specific services or features as clearly indicated

User Eligibility & Account Requirements
To use Kshetra AI services, you must meet specific eligibility criteria:
Age & Legal Requirements
- You must be at least 18 years old or have reached the age of majority in your jurisdiction
- You must have the legal capacity to enter into binding contracts
- You must not be prohibited from using our services under applicable laws
- You represent that all information provided is accurate and truthful
Account Responsibilities
- Maintain the confidentiality and security of your account credentials
- Notify us immediately of any unauthorized access or security breaches
- Accept responsibility for all activities conducted under your account
- Provide accurate, current, and complete information during registration

Service Usage & Permitted Activities
Our AI-powered Vastu services are provided for specific lawful purposes:
- Personal consultation and guidance for residential and commercial properties
- Educational purposes to learn about Vastu Shastra principles and applications
- Professional use by consultants and architects with proper attribution
- Research and analysis for academic or business purposes within fair use guidelines
- Integration with other services only with our express written permission

Intellectual Property Rights
All content and technology on Kshetra AI is protected by intellectual property laws:
Our Proprietary Rights
- AI algorithms and machine learning models for Vastu analysis
- Website design, user interface, and user experience elements
- Content, images, graphics, logos, and branding materials
- Software code, databases, and technical infrastructure
- Vastu knowledge base and recommendation systems
Your Content Rights
- You retain ownership of personal information and property details you provide
- You grant us a limited license to use your data for service delivery
- You can request removal of your content at any time (subject to legal requirements)
- We do not claim ownership of your personal Vastu reports or recommendations

Payment Terms & Billing
Financial transactions are governed by clear terms and secure processing:
- All payments are processed through secure, PCI-compliant payment gateways
- Prices are shown before you pay. Buyers billed in India pay in Indian rupees plus 18% GST; buyers billed outside India pay in US dollars with no Indian GST once card payments in dollars are open, and their bank may add its own foreign-card or conversion fee
- Subscription services are billed in advance on a recurring basis
- One-time services are charged upon completion of the analysis or consultation
- We reserve the right to modify pricing with 30 days' notice to existing subscribers
- Payment failures may result in service suspension until resolved
- Refunds are processed according to our separate Refund Policy

Service Availability & Performance
We strive to provide reliable and high-quality services with certain considerations:
- Services are provided 'as is' and 'as available' without guarantees of uninterrupted access
- We maintain 99.5% uptime target but may experience occasional maintenance downtime
- AI analysis accuracy improves continuously but is not guaranteed to be 100% precise
- Service features may be updated, modified, or discontinued with reasonable notice
- We reserve the right to refuse service or terminate accounts for terms violations
- Third-party integrations may affect service availability beyond our control

Kshetra AI Usage & Top-ups
Kshetra AI (design chat and interior views) comes with a usage allowance:
- Kshetra Design and Kshetra Redesign include a monthly allowance for six months after purchase; studio plans include a monthly allowance for the studio
- Usage depends on what each request involves, so larger changes use more; each 5-hour session can use part of the monthly allowance
- Your current usage and reset times are shown in Account → Kshetra AI (or Studio → Plan & billing)
- Unused monthly allowance doesn't carry over; top-up packs are used after the included allowance and don't expire
- Top-ups are for use on Kshetra and can't be transferred; refunds follow our Refund Policy
- We may limit unusual or automated use to keep the service fair for everyone

Privacy & Data Protection
We handle personal data under India's Digital Personal Data Protection Act 2023 and Rules 2025, as set out in our privacy notice:
- We use your details only for the purposes in the privacy notice you agree to, and anything more (updates, offers) only with your separate permission
- You can see, download, correct and delete your data, change your permissions and name a nominee in Account → Privacy
- Questions and complaints go to our Grievance Officer at privacy@kshetra.ai; you may also complain to the Data Protection Board of India
Studios, builders and brokers (data you add about your clients)
- For your clients' details you are the Data Fiduciary and Kshetra is your Data Processor: we store and process them only to run your account, on your instructions
- You must have your client's agreement before adding their details, and contact them only as they've allowed (Kshetra records what was agreed on its own forms)
- Enquiries and bookings that reach you through Kshetra come with the person's agreement to share their details with you, for that purpose
- We keep client data secure, tell you without delay about any breach affecting it, help you answer your clients' requests, and delete it when you close your account (except what the law requires us to keep)
- Don't export or reuse enquirers' details for unrelated marketing without their permission
Listings
- You confirm you have the right to publish the photos, plans and descriptions you list, and the owner's permission to list the property
- Never put an owner's or tenant's personal contact details in a listing's text or photos; buyers reach you through Kshetra's enquiry form

Limitation of Liability & Disclaimers
Important limitations and disclaimers regarding our services:
- Vastu recommendations are based on traditional principles and AI analysis, not guaranteed outcomes
- We are not liable for decisions made based on our recommendations or their consequences
- Our liability is limited to the amount paid for the specific service in question
- We disclaim liability for indirect, incidental, or consequential damages
- Force majeure events (natural disasters, pandemics, etc.) may affect service delivery
- Users should consult qualified professionals for major property decisions
- Our services supplement but do not replace professional architectural or design advice

Termination & Account Management
Terms governing account termination and service discontinuation:
- You may terminate your account at any time through your account settings
- We may suspend or terminate accounts for violations of these terms
- Upon termination, access to paid services continues until the end of the billing period
- We retain the right to delete inactive accounts after 2 years of non-use
- Certain data may be retained for legal compliance even after account termination
- Termination does not affect previously completed transactions or ongoing obligations

Updates & Modifications
How we handle changes to these terms and our services:
- We reserve the right to modify these terms at any time with reasonable notice
- Material changes will be communicated via email and website notification
- Continued use after changes constitutes acceptance of modified terms
- You may terminate your account if you disagree with significant changes
- Version history and effective dates are maintained for transparency
- Emergency changes for legal compliance or security may be implemented immediately

What happens if I disagree with these terms?+
If you disagree with any part of these terms, you must discontinue use of our services immediately. Continued use constitutes acceptance of all terms and conditions.
Can you change these terms without notice?+
We provide reasonable notice for material changes to our terms. Emergency changes for legal compliance or security may be implemented immediately, but we'll notify users as soon as possible.
Who owns the Vastu reports I receive?+
You retain ownership of your personal Vastu reports and recommendations. We own the underlying AI technology and algorithms, but your specific reports belong to you.
What if my account is terminated?+
If your account is terminated for violations, access to paid services continues until the end of your billing period. We may delete inactive accounts after 2 years of non-use with notice.
Are Vastu recommendations guaranteed to work?+
No, Vastu recommendations are based on traditional principles and AI analysis, not guaranteed outcomes. We're not liable for decisions made based on our recommendations. Consult qualified professionals for major decisions.
